The problem isn't if people can see flicker from 10 or 16ms refresh rates.
This IS the problem, even in sunshine (I do not know the "modulation frequency" of that) some people can see a flicker ar 100Hz. Your other points are valid, of course, but do not dismiss this.

Oddly enough - refering to Pers points - nobody saw flicker at ~120Hz (twice the US net frequency)under flourescent lights .
