The datasheet is the only guarantee that you have - as soon as you step outside the parameters specified in the datasheet you are into undefined territory!

You might be lucky and find a few - or even many - devices that appear to work beyond the datasheet specs, but you will be storing up a support nightmare for yourself if you rely upon that for mass production!

when i testd my dev board with a frequency counter it was running at a maximum of 12 Mhz.

What exactly did you measure?
